Acceptable Use Policy | Ark Platforms

Part I: Scope & Purpose

1. Objective of this Policy

This Acceptable Use Policy (“AUP”) outlines the guidelines and requirements for interacting with the digital infrastructure, software, websites, and services provided by Ark Platforms Europe Limited (“Ark Platforms”, “we”, “us”, or “our”). Our goal is to maintain the integrity, security, and reliability of our platform for all clients and partners. By using our Services, you agree to comply with this AUP.

2. Applicability

This policy applies to all users of our Services, including clients who have commissioned custom Software Solutions, Web Development, or 3D Design, as well as visitors to our public-facing websites. It covers any device or network used to access our infrastructure.

Part II: Prohibited Commercial & Illegal Uses

3. Illegal Activities

You may not use our Services for any purpose that violates local, national, or international laws. This includes, but is not limited to: the distribution of fraudulent material, involvement in money laundering, child exploitation, or the promotion of terrorism. We comply with all legal requests for information from relevant authorities if illegal activity is suspected.

4. Spam and Improper Communication

The use of our infrastructure to send unsolicited bulk communications (Spam) is strictly prohibited. This includes the use of our server side resources for the distribution of phishing emails or malware-laden communications.

Part III: System & Network Security

Security Infringements

You are prohibited from attempting to bypass or breach the security measures of Ark Platforms. This includes: unauthorized access to data, systems, or networks (Hacking); probing the vulnerability of our infrastructure without prior authorization; and the introduction of viruses, Trojans, or other malicious code designed to disrupt our operational capability.

5. Denial of Service

Engaging in activities specifically geared toward overwhelming our servers (DDoS attacks) or those of our partners is a violation of this policy. Any action that impairs the ability of other users to access our Services is strictly forbidden.

Part IV: Content Standards

6. Intellectual Property Rights

Users must respect all intellectual property laws. You may not use our Services to store, share, or distribute content that infringes on the copyrights, trademarks, or patents of any third party. Ark Platforms reserves the right to remove infringing material and terminate the accounts of repeat offenders.

7. Prohibited Material

We prohibit the use of our services for the hosting or distribution of content that is defamatory, obscene, harassing, or discriminatory based on race, gender, religion, or sexual orientation.

Part V: Resource Abuse (3D & Software)

8. 3D Render and GPU Usage

For our 3D Design clients, the use of GPU clusters and rendering resources is governed by the specific service agreement. Abuse of these resources, such as utilizing our rendering pipelines for unauthorized high-volume projects or crypto-mining activities, is strictly prohibited and will lead to immediate account suspension and financial penalties.

9. API and Integrated Services

Software Solutions that include API access are subject to rate limiting and fair-use quotas. Reverse-engineering our APIs, attempting to "scrape" excessive data, or utilizing automated scripts to bypass security gates is a breach of this AUP.

Part VI: Enforcement & Monitoring

10. Right to Monitor

Ark Platforms reserves the right to monitor the use of our Services, including technical logs and traffic patterns, to ensure compliance with this AUP. While we respect user privacy, we will act on automated alerts and third-party reports of abuse to protect our ecosystem.

11. Consequences of Breach

Failure to comply with this policy may result in several actions, ranging from a formal warning and temporary service limitation to the permanent termination of your account and the withholding of all deliverables. We also reserve the right to seek damages and report any criminal activity to law enforcement agencies globally.
